1. Introduction

Welcome to Overlanding.capetown.

These Terms & Conditions govern the use of our website, our guided self-drive overlanding tours, and any related services offered by Overlanding.capetown.

By using this website, making an enquiry, paying a deposit, or booking a tour with us, you agree to these Terms & Conditions.

2.  About Us

Overlanding.capetown offers guided self-drive overlanding tours in South Africa and neighbouring regions.

Our tours are designed for travellers using either their own suitable 4x4 vehicle or a rented overlanding vehicle arranged through us or through an approved provider.

3. Bookings

A booking is only confirmed once your booking has been accepted by us in writing and the required deposit has been paid.

We reserve the right to decline or cancel a booking at our discretion before confirmation.

All bookings are subject to availability.

 

4. Payments

A deposit may be required to secure your place on a tour.

The balance must be paid by the due date communicated to you during the booking process.

If full payment is not received by the due date, Overlanding.capetown reserves the right to cancel your booking and retain any non-refundable amounts already paid.

Any bank charges, transfer fees, currency conversion fees, or third-party payment costs are for the client’s account unless otherwise agreed in writing.

 

5. Pricing

All prices are quoted in South African Rand (ZAR) unless otherwise stated.

Prices may change at any time before a booking is confirmed.

Once confirmed in writing, your quoted tour price will remain fixed unless government levies, park fees, permit fees, taxes, supplier costs, or booking details change.

6. Cancellations by Client

If you cancel your booking, deposits may be non-refundable.

Payments already made may be partially refundable depending on how close the cancellation is to the departure date.

Third-party costs already committed on your behalf may also be non-refundable.

Any refund, if applicable, will be determined after deducting committed costs, administrative costs, supplier penalties, permit fees, accommodation costs, and other non-recoverable expenses.

Failure to arrive on time, failure to attend, or leaving a tour early does not automatically entitle you to a refund.

 

7. Changes and Cancellations by Overlanding.capetown

We reserve the right to amend the itinerary, change the order of destinations, substitute accommodation or camps, adjust activities, delay departure, or cancel a tour where necessary due to weather, road conditions, border closures, vehicle issues, safety concerns, permit limitations, low participant numbers, force majeure, or any other circumstances beyond our reasonable control.

Where possible, we will provide a suitable alternative.

If this is not possible, a refund or partial refund may be considered at our discretion, less any unrecoverable third-party costs already incurred.

We are not liable for any indirect losses, including flights, missed connections, accommodation, loss of income, or other personal expenses.

8. Travel Documents and Legal Compliance

All guests are responsible for ensuring they have the correct passport, visas, driver’s licence documentation, border documents, travel insurance, medical cover, and any other legally required documentation.

It is the traveller’s responsibility to ensure compliance with all laws, customs, vehicle regulations, and border requirements relevant to the tour route.

9. Health and Fitness

Guests must ensure they are physically and medically fit to participate in the tour.

By booking, you confirm that you do not have any condition that would make participation unsafe for yourself or others, unless you have disclosed this to us in writing and we have agreed in writing to your participation.

We may refuse participation if we reasonably believe a guest is unfit, unwell, under the influence, or otherwise unable to safely participate in the tour.

10. Vehicles and Driver Responsibility

Guests joining in their own vehicle are solely responsible for ensuring that their vehicle is roadworthy, properly licensed, insured where applicable, suitable for the route, and equipped appropriately for overlanding and 4x4 conditions.

Drivers are responsible for their own driving decisions and for complying with road laws, park rules, and convoy instructions.

Participation in a guided convoy does not transfer responsibility for the operation, condition, or legal compliance of a guest’s vehicle to Overlanding.capetown.

Where a rental or supplied vehicle is used, separate vehicle rental terms may also apply.

11. Nature of the Tour

Our tours are guided self-drive tours.

This means guests drive their own vehicle or an approved rental vehicle.

Routes may include gravel roads, corrugations, remote areas, mountain passes, sand, mud, water crossings, and technical sections.

Travel conditions may vary and may change quickly.

Wildlife areas involve inherent risks.

By booking, you acknowledge and accept the nature of adventure travel and the risks associated with remote overlanding.

12. Assumption of Risk

Participation is at your own risk.

Overlanding.capetown, its owners, guides, staff, contractors, and representatives are not liable for injury, illness, death, theft, loss of property, vehicle damage, breakdowns, delays, missed connections, route changes, weather events, wildlife incidents, road conditions, or any loss arising from participation in the tour, except where liability cannot legally be excluded under applicable law.

13. Guest Conduct

All guests are expected to behave respectfully and responsibly throughout the tour.

We reserve the right to remove any guest from the tour, without refund, if their behaviour places themselves or others at risk, damages property, disrupts the tour, violates local laws or camp rules, or is abusive, aggressive, reckless, or inappropriate.

14. Accommodation, Camps, and Third-Party Services

Accommodation, campsites, parks, activity operators, and third-party service providers are operated independently.

While we plan and coordinate the tour experience, we are not responsible for the acts, omissions, delays, service failures, or changes made by third-party providers.

All third-party services remain subject to their own rules, terms, and availability.

15. Tour Inclusions and Exclusions

Tour inclusions and exclusions will be communicated on the relevant tour page, quotation, or booking confirmation.

Unless specifically stated otherwise, the following are generally excluded: fuel, toll fees, meals and drinks, personal travel insurance, visas, medical costs, vehicle repairs, fines, and personal expenses.

16. Photography and Media

By participating in a tour, you grant Overlanding.capetown permission to use photographs, videos, and other media that may include your image, voice, vehicle, or likeness for marketing, promotional, website, and social media purposes, without compensation.

If you do not want your image used, you must notify us in writing before the tour begins.

17. Website Content

All content on this website, including text, images, logos, branding, itineraries, and design elements, belongs to Overlanding.capetown or is used with permission.

You may not copy, reproduce, republish, distribute, or exploit any content without prior written consent.

18. Accuracy of Information

We aim to keep all website information accurate and up to date.

However, routes, prices, dates, descriptions, vehicle details, accommodations, and inclusions may change from time to time.

Website content is provided for general information only and does not form a binding offer unless confirmed in writing.

19. Privacy

Any personal information submitted through the website, booking forms, or direct communication will be handled responsibly and only used for legitimate business and operational purposes.

By using our services, you consent to us collecting and processing the information reasonably necessary for enquiries, bookings, communication, safety, and service delivery.

20. Force Majeure

We are not liable for failure or delay in performing our obligations where caused by events beyond our reasonable control, including extreme weather, floods, fires, political unrest, strikes, disease outbreaks, border closures, road closures, vehicle supply failures, accidents, or acts of God.

21. Governing Law

These Terms & Conditions are governed by the laws of the Republic of South Africa.

Any disputes arising from these Terms & Conditions or the use of our services shall be subject to the jurisdiction of the South African courts, unless otherwise required by law.

22. Changes to These Terms

Overlanding.capetown may update these Terms & Conditions from time to time.
